Non-domiciled residents.
An Oregon resident may also be someone who isn’t domiciled in Oregon, but:
• Maintains a residence in Oregon, and
• Spends a total of more than 200 days in Oregon during the taxable year. A fraction of a day is considered to be a whole day when figuring the 200 days. We won’t consider you to be a resident if you are in Oregon for a temporary purpose. The burden of proof is on you to show your stay here is only temporary.
Full-year residents
You're a full-year resident and will use Form OR-40 if all of the following are true:
- You think of Oregon as your permanent home.
- Oregon is the center of your financial, social, and family life.
- Oregon is the place you plan on coming back to when you're away.
You're still a full-year resident if you temporarily move out of Oregon, and then move back.
